Washington Athletic Academy/Go Time Athletics Athletics

I hereby acknowledge and agree that participation in any WAA/Go Time Athletics practices, training, lessons, tryouts, scrimmages, games, leagues, tournaments at rented fields or courts or use of Athletic Facilities owned by Go Time Athletics located at, 661 South Orcas Street, Seattle, WA and 4835 West Marginal Way SW, Seattle, WA has inherent risks. In consideration of the services provided by WAA/Go Time Athletics in or outside of the Athletic Facilities, Weight Area, Batting Cages, Volleyball Court, Training Area, sitting areas, their agents, officers, participants, consultants, instructors, employees, and all persons or entities capacity on their behalf (hereinafter referred to as WAA/GTA) I now agree and certify as follows:   1. I acknowledge and fully understand that I the participant (if participant is 18 years of age or older) or parent/legal guardian of the below listed minor participant, will be engaging in activities that may involve risk of serious injury which might result not only from my own actions, inactions, or negligence, but from the actions, inactions, or negligence of others or the conditions of the premises or of any equipment used.   2. Further, that there may be other risks not known or not reasonably foreseeable at this time. The risks may include, but are not limited to: nature of the activity, latent or apparent defects of conditions in equipment or property supplied by the WAA/GTA or other entity; acts of other participants in this activity, employees or agents of WAA/GTA; my own physical condition, acts or omissions; conditions of the WAA/GTA facility and surrounding grounds or terrain and accidents connected with their use; first aid emergency treatment or other services.   3. I expressly agree and promise to accept and assume all the risks existing in this activity. My/Our Minor participating in this activity is purely voluntary and I elect, in spite of the risks, to participate. I assume all the foregoing risks and accept personal responsibility for the damages following such injury.   4. On behalf of myself, my children, my parents, my heirs, assigns, personal representatives I hereby voluntarily release, waive, forever discharge, and agree to indemnify and hold harmless WAA/GTA, and each of their respective instructors commissioners, directors, agents, and other employees, its parent, subsidiaries, affiliates, employees, distributors, and agents, other Batting Cage participants, and, if applicable, operator or lessors of premises used to conduct the event/activity, from any and all liability for any and all claims, demands of causes of action which are in any way connected with my participation in this activity or my use of WAA/GTA equipment or facilities.   5. I hereby certify that I have adequate insurance to cover any injury or damage I may cause or suffer while participating in these activities or alternatively I agree to bear the costs of such injury or damage myself. I further certify that I have no medical or physical conditions, which could interfere with my safety in this activity, or else I am willing to assume and bear the costs of all risks that may be created, directly or indirectly, by any such condition.   6. I hereby certify that I have read and am familiar with the WAA/GTA Facility Rules and Regulations and will comply with conditions set forth therein   7. I acknowledge and certify that I am at least 18 years old, or the parent or legal guardian of the participant under 18, and I agree I or they will wear a helmet at all times while in the Batting Cages. I hereby provide the WAA/GTA permission to administer basic First Aid and I authorize WAA/GTA or its agents or employees to contact 911 or other emergency personnel as needed.   8. PLAYER RESPONSIBILITIES: WAA/GTA is interested in making the Player’s experience safe, happy and rewarding. For this reason we hold high expectations for Player behavior. Players must agree to comply with the rules and standards of WAA/GTA, and to be a positive influence in the WAA/GTA program. Players and their parents/guardians must understand that dismissal from the facility could happen without refund, if behavior or attitude is unacceptable as determined by WAA/GTA personnel.   Permission to Use Likeness I understand that during my participation, Go Time Athletics may take video or still photographs of me. I agree that WAA/GTA may use such video and/or photographs of me for any commercial or promotional purposes they wish, and further agree that I will not seek compensation from the WAA/GTA for such use. I have read the information above and agree to these terms.   By Agreeing to signing this document, I acknowledge that if anyone is hurt, or property is damaged during participation in this activity a court of law may find me to have waived my right to maintain a lawsuit against WAA/GTA and each of the other parties listed in Paragraph 3 above on the basis of any claim from which I have released them herein.  
 

COVID-19 and other Viruses
 

 

COVID-19 
We have taken and implemented health and safety measures for you, your child and our employees however WAA/GTA cannot guarantee that you or your child(ren) will not become infected with COVID-19 or other viruses. Further, attending WAA/GTA could increase your risk and your Child(ren) risk of contracting COVID-19. You and your child(ren) must follow all posted instructions while at WAA/GTA.There is an inherent risk of exposure to COVID-19 or other forms of viruses in any public and private place where people are present.COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers of Disease Control and Prevention, senior citizens and people with underlying medical conditions are especially vulnerable.By entering and working out at WAA/GTA, you and your child voluntarily assume all risks related to exposure to COVID-19 or any other disease.By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending WAA/GTA and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at WAA/GTA may result from the actions, omissions, or negligence of myself and others, including, but not limited to, WAA/GTA coaches, employees, volunteers, and program participants and their families. I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at WAA/GTA or participation in WAA/GTA programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless WAA/GTA, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of WAA/GTA, its employees, agents, and representatives, whether a COVID-19 infection or other infection occurs before, during, or after participation in any Go Time Athletics program. 
I HAVE HAD SUFFICIENT OPPORTUNITY TO READ THE ENTIRE DOCUMENT. I HAVE READ AND UNDERSTOOD IT, AND I AGREE TO BE BOUND BY ITS TERMS. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT AND HAVE SIGNED IT FREELY AND WITHOUT INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THIS AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.
